Kenneth Noland Market Overview

It would be tempting to apply Tolstoy=E2=80=99s famous description of unhap=
py families to artists=E2=80=99 markets=E2=80=94all successful artist=E2=80=
=99s markets are alike=E2=80=94but that=E2=80=99s not really true. Every su=
ccessful market is successful in its own idiosyncratic way. A good case in =
point is the artist Kenneth Noland. [ https://substack.com/redirect/0b1fe96=

5iRnigHXx6Fx_g6pp7gWdY ] A giant of the color field movement, Noland was an=
 artist whose bona fides were established quite early with participation in=
 the Venice Biennale in 1964 and a major touring retrospective of his work =
organized by the Guggenheim in 1977.
Although Noland=E2=80=99s body of work is large and varied, his most sought=
 after works are the circles and chevrons that dominate the upper reaches o=
f his price spectrum. In the decade from 2010 to 2020, 11 works sold at auc=
tion above $1 million. In the last three years, seven Nolands have sold for=
 more than $1 million. That=E2=80=99s a quickening of pace. In that previou=
s decade, five works made more than $2 million but so far since 2020 anothe=
r five had sold as well, including a new record in 2021 at $4.2 million tha=
t many have hoped would signal a new register for the artist.

as owned by John and Anne Marion. In contrast, William Paley=E2=80=99s Soun=
ds in the Summer Night from 1962 failed to gain momentum when it was sold a=
s part of a group of MoMA pictures last Fall.=C2=A0It sold for  it sold for=
 just under $3.2 million.
To put these numbers in perspective, a spectacular $2 million dollar sale i=
n 1989 for Empyrean [ https://substack.com/redirect/a53aad26-c637-4d73-9590=

7gWdY ] which was estimated at $500,000 created an expectation that Noland=
=E2=80=99s work would trade at levels on par with the Abstract Expressionis=
ts that have dominated the blue chip market.=C2=A0
At the time, Lucy Mitchell-Innes remarked that [ https://substack.com/redir=

0jQmMpisrMe5iRnigHXx6Fx_g6pp7gWdY ] Empyrean was being resold 8 years after=
 it was first auctioned for $330,000 because, =E2=80=9CThis is the best tar=
get I have seen since that sale.=E2=80=9D Her remarks are a reminder that f=
ew circle paintings are in private hands and new sales are often repeat sal=
es.=C2=A0
Nevertheless, it would take nearly 25 years before two sales at the $2 mill=
ion level confirmed Noland=E2=80=99s price level. Two years later, Heat [ h=

e record at $3.3 million quadrupling in price over 15 years.=C2=A0
One clue to Noland=E2=80=99s market prospects might come from his close con=
fidant, Morris Louis. It isn=E2=80=99t always helpful to compare artists=E2=
=80=99 markets but here it is instructive that Louis and Noland seem to pos=
t similar auction prices. Louis=E2=80=99s sales seem to precede Noland=E2=
=80=99s sales. Not only does Louis have top auction prices almost 36% highe=
r, there are also a handful more works that have sold above $3 million. Is =
this the future for Noland=E2=80=99s auction sales?

For some reason, Ezra Chowaiki thinks writing a breathless version of the a=
rt world where everyone is a rogue but no one else gets caught will somehow=
 bury the story of how he got himself sent to prison.
I=E2=80=99ve seen kickbacks given to art advisers, museum directors, and au=
ction-house specialists. I=E2=80=99ve witnessed the most esteemed, authorit=
ative scholars authenticate works which were not only fake but which they k=
new were fake, in exchange for sizable sums of money. [=E2=80=A6] But the b=
usiness is so secretive, and so opaque, that even though lies and fraud are=
 rampant, no one gets in trouble.
Except, it turns out, a schmuck like me.
In Chowaiki=E2=80=99s telling, he=E2=80=99s not a bad guy. He just did bad =
things because he believes he=E2=80=99s some kind of man of honor. =E2=80=
=9CI didn=E2=80=99t intend to screw anyone,=E2=80=9D he writes.=E2=80=9DI s=
imply tried to buy time and pay everyone back eventually, as I had done man=
y times before.=E2=80=9D
Throughout the account, which we=E2=80=99re warned is part of a book he is =
writing, Chowaiki tries to suggest he was an upstanding guy in a dirty worl=
d. Others did far worse than he. For example,
A few years ago, the royal House of Alba consigned a Renoir to my gallery t=
o sell. A friend=E2=80=94a good friend=E2=80=94had told me she had a buyer =
for it. Negotiations became protracted, and I had to extend my contract wit=
h the House of Alba by putting down a deposit of $500,000. In the end my fr=
iend=E2=80=99s buyer backed out=E2=80=94I later found out they were never e=
ven interested=E2=80=94I lost my deposit, and my friend never repaid me. Ge=
tting screwed is an occupational hazard of the business. But after 17 years=
 of resisting any shenanigans=E2=80=94and having lost millions for all my g=
ood conduct=E2=80=94I finally succumbed to temptation.
It=E2=80=99s not clear of Chowaiki understands that his own story points to=
 his poor judgment. Instead of simply returning the painting, the ever-hope=
ful Chowiaki recklessly lost half a million dollars.=C2=A0
Even before Chowaiki got involved in fraud, he had pursued a number of bad =
deals that cost him and his gallery millions. In one, he bankrolled a lawsu=
it hoping to have access to art works in an inheritance. In another, he par=
tnered with Sotheby=E2=80=99s on a Matisse painting that was bought for $12=
 million and sold after four years holding for $4.75 million. Chowiaki was =
lucky to only be responsible for half of the loss. Sotheby=E2=80=99s had pa=
rtnered with him on the painting and took their own multi-million-dollar be=
ating.=C2=A0
Chowaiki=E2=80=99s erstwhile business partner, on the other hand, was disci=
plined enough to refuse to be a party to the Matisse-Sotheby=E2=80=99s deal=
=2E As these examples show, Chowaiki=E2=80=
=99s naiv=C3=A9t=C3=A9 wasn=E2=80=
=99t new. Nor did he learn from experience. When he finally, in 2017, confe=
ssed his crimes to his business partner, he was shocked that the informatio=
n could and would be used against him both in civil litigation and criminal=
ly.=C2=A0
This is the same business partner Chowaiki writes in Air Mail =E2=80=9Cgot =
spooked and turned [him] in.=E2=80=9D But what=E2=80=99s shocking about Cho=
waiki=E2=80=99s account isn=E2=80=99t that his business partner lost faith =
in him, it=E2=80=99s that it took nine years from the ill-fated Matisse dea=
l until he did.

Lawrence Weschler has a compelling profile-cum-argument for considering ind=
ependent scholar Benjamin Binstock=E2=80=99s thesis that Vermeer had a daug=
hter who served as his studio assistant. In Binstock=E2=80=99s view, some o=
f the paintings that emerged from Vermeer=E2=80=99s studio after his death =
were by his daughter Maria. Only recently have art historians begun to beli=
eve that Vermeer worked with an assistant even though there are no official=
 records of the artist having employed one and the record keeping was not a=
 casual thing. If Vermeer=E2=80=99s daughter served as his assistant, no re=
cord would have been required.=C2=A0
In addition, Binstock makes use of close readings of Vermeer=E2=80=99s pain=
tings and the models to construct a case for Maria to have been the artist =
behind half a dozen paintings now on view in the largest gathering of Verme=
ers in a generation at the Rijksmuseum in Holland. Weschler=E2=80=99s Atlan=
tic article focuses on Binstock=E2=80=99s thesis but also wonders repeatedl=
y why the art historical profession won=E2=80=99t engage with or acknowledg=
e Binstock=E2=80=99s work. It all comes down to =E2=80=A6
Documentation and consensus. The issue with the first is what gets to count=
 as =E2=80=9Cdocumentation=E2=80=9D=E2=80=94or as evidence more generally=
=E2=80=94given the current mindset of this academic field. I was reminded o=
f the presentation by James Elkins, at the 2013 symposium, in which he tick=
ed off the many avenues Binstock had pursued: conservation studies, provena=
nce tracing, legal records, church records, art-market records. Elkins lame=
nted that most of those sources of insight are =E2=80=9Cperipheral to the c=
urrent concerns of the discipline.=E2=80=9D (Elkins devoted a chapter to Bi=
nstock and to this and other questions in his 2017 collection, What Is Inte=
resting Writing in Art History?) Whether or not one goes along with Binstoc=
k=E2=80=99s interpretation, any reader of Binstock=E2=80=99s book cannot he=
lp but be struck by the onslaught of factual information, over and beyond t=
he internal evidence of the paintings themselves. There is, of course, no b=
ill of sale bearing the name Maria Vermeer, but there is enough documentati=
on to underpin considerable circumstantial speculation about Vermeer=E2=80=
=99s life and family.
As for consensus, the difficulty with that concept is its self-reinforcing =
circularity. How can one be expected to affect the consensus if one is not =
already of it, or is steadfastly ignored by the gatekeeping establishment? =

ant of the color field movement, Noland was an artist whose bona fides were=
 established quite early with participation in the Venice Biennale in 1964 =
and a major touring retrospective of his work organized by the Guggenheim i=
n 1977.</span></p><p style=3D"color: #404040; font-size: 16px; line-height:=
 26px; margin: 0 0 20px 0;">Although Noland&#8217;s body of work is large a=
nd varied, his most sought after works are the circles and chevrons that do=
minate the upper reaches of his price spectrum. In the decade from 2010 to =
2020, 11 works sold at auction above $1 million. In the last three years, s=
even Nolands have sold for more than $1 million. That&#8217;s a quickening =
of pace. In that previous decade, five works made more than $2 million but =
so far since 2020 another five had sold as well, including a new record in =
2021 at $4.2 million that many have hoped would signal a new register for t=
he artist.</p><p style=3D"color: #404040; font-size: 16px; line-height: 26p=

 36% higher, there are also a handful more works that have sold above $3 mi=

 because he believes he&#8217;s some kind of man of honor. &#8220;I didn&#8=
217;t intend to screw anyone,&#8221; he writes.&#8221;I simply tried to buy=
 time and pay everyone back eventually, as I had done many times before.&#8=

gin: 0 0 20px 0;">Throughout the account, which we&#8217;re warned is part =
of a book he is writing, Chowaiki tries to suggest he was an upstanding guy=
 in a dirty world. Others did far worse than he. For example,</p><blockquot=

nsigned a Renoir to my gallery to sell. A friend&#8212;a </span><em>good</e=
m><span> friend&#8212;had told me she had a buyer for it. Negotiations beca=
me protracted, and I had to extend my contract with the House of Alba by pu=
tting down a deposit of $500,000. In the end my friend&#8217;s buyer backed=
 out&#8212;I later found out they were never even interested&#8212;I lost m=
y deposit, and my friend never repaid me. Getting screwed is an occupationa=
l hazard of the business. But after 17 years of resisting any shenanigans&#=
8212;and having lost millions for all my good conduct&#8212;I finally succu=
mbed to temptation.</span></p></blockquote><p style=3D"color: #404040; font=
-size: 16px; line-height: 26px; margin: 0 0 20px 0;">It&#8217;s not clear o=
f Chowaiki understands that his own story points to his poor judgment. Inst=
ead of simply returning the painting, the ever-hopeful Chowiaki recklessly =
lost half a million dollars.&#160;</p><p style=3D"color: #404040; font-size=
: 16px; line-height: 26px; margin: 0 0 20px 0;">Even before Chowaiki got in=
volved in fraud, he had pursued a number of bad deals that cost him and his=
 gallery millions. In one, he bankrolled a lawsuit hoping to have access to=
 art works in an inheritance. In another, he partnered with Sotheby&#8217;s=
 on a Matisse painting that was bought for $12 million and sold after four =
years holding for $4.75 million. Chowiaki was lucky to only be responsible =
for half of the loss. Sotheby&#8217;s had partnered with him on the paintin=
g and took their own multi-million-dollar beating.&#160;</p><p style=3D"col=

iki&#8217;s erstwhile business partner, on the other hand, was disciplined =
enough to refuse to be a party to the Matisse-Sotheby&#8217;s deal. As thes=
e examples show, Chowaiki&#8217;s naiv&#233;t&#233; wasn&#8217;t new. Nor d=
id he learn from experience. When he finally, in 2017, confessed his crimes=
 to his business partner, he was shocked that the information could and wou=
ld be used against him both in civil litigation and criminally.&#160;</p><p=

ked off the many avenues Binstock had pursued: conservation studies, proven=
ance tracing, legal records, church records, art-market records. Elkins lam=
ented that most of those sources of insight are &#8220;peripheral to the cu=

ugh documentation to underpin considerable circumstantial speculation about=
