### **The Scientific Mystery of Psilomethoxin Is Reignited by New Test Resu=
lts and Lawsuits**

_Church of Sacred Synthesis claims new test results vindicate their sacrame=
nt=E2=80=99s legitimacy, and sue Hamilton Morris and Usona Institute over a=
lleged trade secrets in response._

The Church of Sacred Synthesis has been no stranger to controversy.

The church =E2=80=94 formerly known as [The Church of Psilomethoxin](https:=
//doubleblindmag.com/church-of-psilomethoxin/) =E2=80=94 has claimed for ye=
ars it can produce a novel psychedelic drug called =E2=80=9Cpsilomethoxin.=
=E2=80=9D Its founders say that by feeding toad-derived[ 5-MeO-DM](https://=
doubleblindmag.com/eight-truths-about-5-meo-dmt-from-two-experts/)T to psil=
ocybin mushroom substrate, the fungi is coaxed into biosynthesizing the com=
pound. Multiple chemists tested samples of the sacrament, but none could de=
tect it, ultimately putting the church=E2=80=99s reputation on the line and=
 causing [the church=E2=80=99s founders to sue its public critics.](https:/=
/doubleblindmag.com/church-of-psilomethoxin-lawsuit/) Psilomethoxin has sin=
ce remained at the center of a legally contentious saga that=E2=80=99s unfo=
lded since 2023, with the church still trying to prove its sacrament is leg=
itimate today =E2=80=94 now with a new round of testing allegedly proving t=
he existence of psilomethoxin and a brand new lawsuit.=C2=A0

It all started in 2022, when Hamilton Morris =E2=80=94 a chemistry consulta=
nt for [Compass Pathways](https://doubleblindmag.com/psilocybin-isnt-legal-=
yet-so-why-are-states-writing-laws-for-it/) and former host of the show _Ha=
milton=E2=80=99s Pharmacopoeia =E2=80=94 _tested a sample of the sacrament =
and found no psilomethoxin. Over the next year, chemists at three more labs=
 tested it and reached the same conclusion: Only the presence of psilocybin=
 was detected. Morris' analysis also turned up ketamine. Now, an Alabama-ba=
sed forensic toxicologist named Jesse Hines has entered the fray, and he sa=
ys his lab testing equipment detected [psilomethoxi](https://doubleblindmag=
.com/church-of-sacred-synthesis-defamation-case-dismissed/)n in the sacrame=
nt. But verifying the presence of the compound is difficult for a few reaso=
ns. One is because there=E2=80=99s no agreed-upon reference standard for ps=
ilomethoxin, and there=E2=80=99s only been one instance of a successful syn=
thesis that was documented in the 1960s. Another is because it=E2=80=99s hi=
ghly sensitive to heat. Even [renowned chemist Alexander Shulgin](https://d=
oubleblindmag.com/ann-and-sasha-shulgin-live-on-at-the-mdma-archive-exhibit=
ion/) noted its volatility in his seminal text _TiKHAIL: Tryptamines I Have=
 Known and Loved._=C2=A0

Even still, the church is citing Hines=E2=80=99 results as vindication. On =
April 6, 2026, it sued Morris and Alexander Sherwood, the head of medicinal=
 chemistry at the [Usona Institute](https://www.usonainstitute.org/), alleg=
ing that their prior public skepticism over the validity of the church=E2=
=80=99s sacrament was secretly [financially motivated.=C2=A0](https://doubl=
eblindmag.com/how-to-tell-a-safe-psychedelic-facilitator-from-a-predator/)

=E2=80=9CGetting our sacrament allowed [Sherwood] to have a psilomethoxin p=
rodrug that they could analyze at Usona, as they're doing studies on very s=
imilar [compounds to psilomethoxin]," claimed Ian Benouis, co-founder and l=
egal co-counsel for the church, in an interview with _DoubleBlind. _We reac=
hed out to Sherwood and Morris, both of whom are personally named in the on=
going lawsuits, to ask whether their respective companies are researching d=
rugs similar to psilomethoxin. Neither provided comment for the story.=C2=
=A0

The lawsuit alleges that Morris gave a sample of the sacrament to Sherwood =
without consent. The church=E2=80=99s legal argument is that Sherwood and T=
he Usona Institute =E2=80=94 which it deems competitors =E2=80=94 committed=
 a trade secrets violation by freely investigating a confidential and comme=
rcially valuable compound, allowing them to mine it for the assumed eventua=
lity of bringing a psilomethoxin drug to market. Contrary to these claims, =
Sherwood stated in [=E2=80=9CFungi Fiction=E2=80=9D](https://www.researchga=
te.net/publication/369951491_Fungi_Fiction_Analytical_Investigation_into_th=
e_Church_Of_Psilomethoxin's_Alleged_Novel_Compound_Using_UPLC-HRMS)=C2=A0 =
=E2=80=94 a research paper disputing the presence of psilomethoxin in the s=
acrament that kicked off this legal saga in 2023 =E2=80=94 that the authors=
 have no competing financial interests.

Robert Rush, an attorney who specializes in psychedelics and founder of the=
 [Rights and Reason Project,](https://www.rightsandreasonproject.com/) told=
 _Doubleblind_ that after reviewing the contents of the lawsuit, he=E2=80=
=99s skeptical of the trade secrets-related claims. =E2=80=9CMy view is tha=
t this latest round of litigation attempts to convert a public scientific d=
isagreement into a trade-secret fight,=E2=80=9D he said. =E2=80=9CThe Churc=
h publicly promoted and sold the very sacrament it now claims is connected =
to confidential trade secrets.=E2=80=9D=C2=A0

Rush also noted that the church already litigated their claims in court, an=
d that the presiding judge dismissed the case at the time. =E2=80=9CIn my o=
pinion, this case looks less like a conventional intellectual-property disp=
ute and more like another effort to chill scientists, journalists, and crit=
ics whose analysis the Church did not like.=E2=80=9D



### **New Lab Test Results**

Benouis and the church sought out the scientific expertise of Hines, the fo=
rensic toxicologist, for a few reasons. One is that he=E2=80=99s a physicis=
t with an expertise in advanced mass spectrometers and owns a toxicology la=
b called [Golden Point Scientific](https://goldenpointlabs.com/). Another i=
s because multiple previous lab tests failed to detect psilomethoxin in the=
 church's samples. After an =3D=3Dinconclusive analysis from a facility at =
the University of South Florida=3D=3D, Benouis realized that in order to ob=
tain conclusive proof he needed access to better equipment.

Hines suggested using Ultra-Performance Liquid Chromatography with High-Res=
olution Mass Spectrometry (UPLC-HRMS) to see if psilomethoxin was present, =
after learning that previous labs had only relied on Gas Chromatography-Mas=
s Spectrometry (GC-MS). Hines offered to analyze the samples free of charge=
 using his Orbitrap Ion Trap Mass Spectrometer, a much more sensitive tool =
than other labs used, to process the sample as a liquid. Because this metho=
d applies almost no heat, the original chemical structure remains intact, a=
llowing UPLC-HRMS to easily distinguish between nearly identical compounds.=
 =E2=80=9CWhat I'm actually doing with a mass spectrometer is measuring the=
 actual weight of the compound at the molecular level,=E2=80=9D Hines said.=
=C2=A0

In a [sworn affidavit](https://drive.google.com/file/d/1FNLG9Z-Y-IBIxIpOjoK=
VFY5hKmr9SbBo/view?usp=3Dsharing) filed as part of the Church=E2=80=99s new=
est lawsuit, Hines and Elizabeth Gardner =E2=80=94 a forensic scientist at =
the University of Alabama at Birmingham =E2=80=94 state that they are more =
than 98% confident that the sacrament contains psilomethoxin. =E2=80=9CIn o=
ur professional opinion, the data proves psilomethoxin is present in the sa=
crament,=E2=80=9D the document says.

Benouis and the church maintain in their new lawsuit that a reference stand=
ard is not required to identify a new natural product if the analytical dat=
a is sufficiently strong.=C2=A0=C2=A0

But providing sufficient analytical data for an obscure compound like psilo=
methoxin is difficult for a couple of reasons: Almost no one has ever made =
it, and thus, no verified sample of it exists today. The only documented in=
stance of a psilomethoxin synthesis occurred in 1965, when a team of chemis=
ts at France's Pasteur Institute [successfully synthesized the molecule](ht=
tps://bibliography.maps.org/bibliography/default/resource/16037) from vanil=
la orchids. But they failed to preserve the end product or add it to a refe=
rence library, so researchers can=E2=80=99t replicate their work today. In =
other words, there is [no verified sample](https://doubleblindmag.com/notes=
-from-the-underground-mushroom-market/) of psilomethoxin for chemists to ch=
eck their own against, so even when they try and make it, there is no way t=
o confirm success.

Critics of the church say that without conducting further complex testing, =
Hines=E2=80=99 findings are theoretical rather than confirmed.

=E2=80=9CClaiming the discovery of a new chemical typically requires confir=
ming it against a verified reference sample or using a technique like nucle=
ar magnetic resonance (NMR) to directly confirm the atomic structure,=E2=80=
=9D said Manesh Girn, scientific director for [The Center for MINDS](https:=
//centerforminds.org/) and host of [The Psychedelic Scientist Podcast](http=
s://www.youtube.com/c/thepsychedelicscientist). =E2=80=9CThey did not appea=
r to do either, yet the affidavit assigns very high probabilities and even =
claims certainty =E2=80=98beyond reasonable doubt.=E2=80=99 That level of c=
ertainty would be unusual in a scientific context without the above-mention=
ed checks."

In other words, standard scientific methodology demands independent verific=
ation. "If the goal were truly to conclusively demonstrate the compound=E2=
=80=99s presence, one might expect a more thorough approach,=E2=80=9D Girn =
said, =E2=80=9Cincluding comparison to a verified reference sample, structu=
ral confirmation by NMR [nuclear magnetic resonance], and, ideally, indepen=
dent replication by a third-party laboratory.=E2=80=9D

Both Sherwood and Morris have argued that the compound's absence in their o=
wn analyses proves it does not exist in the tested samples. Hines contends =
that it=E2=80=99s plausible Sherwood=E2=80=99s Mass Spectrometer might not =
have been tuned to the highest level of sensitivity possible, according to =
the testing protocol Sherwood documented in his pre-print research paper.=20

Hines tells _DoubleBlind_ that the 98% certainty metric cited in the sworn =
affidavit is because, =E2=80=9C[Ian] is putting together the percentages fo=
r a legal defense=E2=80=9D and is not rooted in any specific standard of pr=
oof required to establish undeniable evidence of a [novel scientific discov=
ery](https://doubleblindmag.com/inside-sasha-shulgins-lab/). But two things=
 can be true at once: Hines also stands firmly by his conclusion that the e=
lusive and highly volatile psilomethoxin compound is present in the samples=
 he=E2=80=99s tested.

=E2=80=9CI've conducted about a dozen tests,=E2=80=9D said Hines, =E2=80=9C=
I have no doubt about it. I'm kind of more surprised that somebody hasn't d=
iscovered it before now.=E2=80=9D



### **Mail-Order Mushroom Church**

The Church of Sacred Synthesis first gained notoriety back in 2021 after Be=
nouis and Greg Lake, who is a co-founder of the church and also an attorney=
, announced the creation of their novel psychedelic compound. Marketed onli=
ne as a "mail-order mushroom church," the organization offered their sacram=
ent to members while aiming for broader mainstream accessibility. The sacra=
ment was sold as capsules for $300 an ounce, tallying the church=E2=80=99s =
monthly income to almost =E2=80=9C$100,000 in membership fees and sacrament=
 sales,=E2=80=9D according to Benouis.=C2=A0

In 2022, the church contacted Hamilton Morris and sent him a sample of thei=
r sacrament for testing. He performed the analysis and privately informed B=
enouis that testing with a Gas Chromatography Mass Spectrometer (GC-MS) had=
 not detected the presence of psilomethoxin in the sacrament. In 2023, chem=
ists from at least three other [laboratories tested different samples](http=
s://doubleblindmag.com/fda-investigates-diamond-shruumz/) of the church=E2=
=80=99s sacrament and came to the same conclusion. Sherwood was among those=
 who conducted testing in 2023 using a mass spectrometer with UHPLC technol=
ogy (similar to Hines=E2=80=99 machine) and at the time asserted that no ps=
ilomethoxin was present in the sample.

The findings were published in a paper called =E2=80=9CFungi Fiction,=E2=80=
=9D and at the time Sherwood implied that the church was essentially distri=
buting traditional [psilocybin-containing mushrooms](https://doubleblindmag=
.com/the-ultimate-guide-to-z-strain-mushrooms/). In response to the backlas=
h online, the organization rebranded itself as =E2=80=9CThe Church of Sacre=
d Synthesis=E2=80=9D and filed defamation lawsuits against their critics.=
=C2=A0

Other experts in the field were also highly skeptical at the time. For exam=
ple, Purdue University's Dr. David Nichols described the alleged cultivatio=
n process by members of the church as =E2=80=9Cnonsensical and nonscientifi=
c."=20

But Hines counters Sherwood=E2=80=99s testing assertions, pointing out that=
 =E2=80=9CFungi Fiction=E2=80=9D was never subject to a thorough peer revie=
w process, as Sherwood=E2=80=99s test results were only published as a pre-=
print, meaning the initial research findings did not undergo rigorous revie=
w by subject matter experts, a requirement for full publication in a reputa=
ble scientific research journal. =E2=80=9CI think on peer review somebody w=
ould go =E2=80=98well you didn't see [psilomethoxin] but you also=E2=80=A6 =
didn't use the full capabilities of this machine.=E2=80=9D=20



### **The Defense Responds**

The Usona Institute, Sherwood, and Morris filed a motion to dismiss the law=
suit altogether on June 15, 2026, citing an array of legal statutes and pre=
cedents arguing that even beyond the alleged legitimacy of the new test res=
ults, the church=E2=80=99s trade secrets claims are null and void due to th=
e potentially illegal nature of their sacrament [commercialization efforts]=
(https://doubleblindmag.com/the-scariest-part-about-psychedelic-mainstreami=
ng/).=20

=E2=80=9CLong ago,=E2=80=9D the motion reads, =E2=80=9Cthe Texas Supreme Co=
urt held that =E2=80=98no action will lie to recover a claim for damages, i=
f to establish it the plaintiff requires aid from an illegal transaction, o=
r is under the necessity of showing or in any manner depending upon an ille=
gal act to which he is a party. This admission dooms this lawsuit because t=
he trade secret misappropriation claim is intertwined with Plaintiffs=E2=80=
=99 illegal acts.=E2=80=9D=C2=A0

Furthermore, the motion to dismiss highlights Benouis and the church=E2=80=
=99s rejected Trademark application for =E2=80=9CPsilomethoxin=E2=80=9D wit=
h the US Patent and Trademark Office (USPTO), of which the USPTO noted that=
 the Church had, =E2=80=9Cno bona fide intent to use [the trademark] on law=
ful goods, that is, because the applicant does not have a bona fide intent =
to lawfully use the applied-for [trade]mark in commerce.=E2=80=9D

The motion also says the =E2=80=9Ctrademark office held that psilomethoxin =
is =E2=80=98structurally and pharmacologically similar to Psilocybin,=E2=80=
=99 a Schedule I drug, and thus is also a Schedule I drug under [The Contro=
lled Substances Act].=E2=80=9D

Benouis and the Church of Sacred Synthesis have drafted a motion for partia=
l summary judgment, but Benouis says he expects the church to file it in ro=
ughly 1 to 2 months.

=80=9Call claims against Defendant Hamilton Morris for a lack of personal j=
urisdiction.=E2=80=9D At the time of publication, Sherwood, The Usona Insti=
tute, Compass Pathways, and other defendants remain in the case.



### **Psilomethoxin As a Nutraceutical**

The question of whether the church was operating commercially is further co=
mplicated by a contract with a biotech company called [CB Therapeutics Inc.=
](https://www.cbthera.com/) The deal is held by Psilosynth =E2=80=94 a priv=
ate company also founded by Benouis =E2=80=94 which would help the church m=
anufacture psilomethoxin for commercial sale.

Psilosynth signed the Master Services Agreement in July 2023 and the agreem=
ent establishes a five-year term for CB Therapeutics to provide services. S=
pecific financial and operational details =E2=80=94 such as budgets, timeli=
nes, and exact deliverables =E2=80=94 are not detailed. Benouis told _Doubl=
eBlind_ that once additional testing gives them even greater confirmation o=
f legitimacy, the deal will move forward and be valued at $1.8 million over=
 a 24-month production timeline.

We reached out to Sher Ali Butt, CB Therapeutics founder and CEO, about det=
ails of the contract and production timeline. These details, however, remai=
n confidential. =E2=80=9CWe do not comment on confidential commercial discu=
ssions or agreements,=E2=80=9D Butt wrote to us in an email, suggesting tha=
t any plans of mass production may be premature. He also noted that the com=
pany has not =E2=80=9Cbegun any experimental work in that area.=E2=80=9D In=
 other words, CB Therapeutics would need to conduct additional research to =
determine if the alleged psilomethoxin compound is even the drug it claims =
to be and if it can be mass produced at all.=C2=A0

While mass production of the compound remains in limbo, Benouis told _Doubl=
eBlind_ that the church hopes to bypass the religious exemption process alt=
ogether and sell the substance as a =E2=80=9Cnutraceutical.=E2=80=9D Religi=
ous organizations who work with psychedelic drugs, like the Church of Sacre=
d Synthesis, are required to be compliant with the Religious Freedom Restor=
ation Act (RFRA) in order to [receive a Religious Freedom Exemption Waiver =
from the Drug Enforcement Administration](https://doubleblindmag.com/deas-p=
rocess-for-religious-use-of-psychedelics-needs-more-consistent-standards-go=
vernment-watchdog-agency-says/). This paperwork grants legal protections to=
 churches who serve Schedule I drugs as[ religious sacraments.](https://dou=
bleblindmag.com/heres-how-church-of-gaia-beat-the-dea-to-serve-ayahuasca/)

Allison Hoots, the [Sacred Plant Alliance=E2=80=99s e](https://www.sacredpl=
antalliance.org/)xecutive director and an attorney who specializes in relig=
ious freedom laws as they pertain to psychedelic churches, expressed doubts=
 regarding the legal viability of the church=E2=80=99s plans. =E2=80=9CIf w=
e're just looking at whether [the church] might be defensible under a RFRA =
exemption analysis, the key components that the government is going to look=
 at is religious sincerity,=E2=80=9D said Hoots in an interview with _Doubl=
eBlind. _=E2=80=9CAnd then [the DEA is] going to look at whether the sacred=
 substance or sacrament is being solely used for religious purposes and if =
diversion to non-religious purposes is being prevented as much as possible =
=E2=80=94 just like a pharmacy or any other DEA registrant.=E2=80=9D

And the more visible the church becomes =E2=80=94 through lawsuits or mass =
production =E2=80=94 the more scrutiny it invites, since the DEA weighs exa=
ctly the kind of commercial activity Hoots describes. As Rush points out, m=
ost churches aren't fielding discussions about valuations in the hundreds o=
f millions.

=E2=80=9CAs I understand the allegations,=E2=80=9D Rush said, =E2=80=9Cthe =
Church claims an enterprise value in the hundreds of millions of dollars ba=
sed on discussions with prospective investors. That is unusual language for=
 an organization presenting itself as a church, and it underscores the tens=
ion at the heart of the case: whether this is really about protecting sacre=
d religious practice, or about defending what is speculated to be a commerc=
ially valuable psychedelic enterprise from public scrutiny.

For now, the compound at the center of it all remains exactly what it has b=
een for years: still unproven and unregulated, but impossible to ignore.
