For Employers, the Act represents a shift towards greater accountability, 
transparency and procedural formality in how employee data is handled.




1. Mandatory data protection complaints process (from 19 June 2026)

*	All organisations that process personal data must implement a formal 
complaints procedure.
*	Employers must provide accessible channels for complaints, acknowledge 
them within 30 days of receipt, investigate and respond without undue delay 
and communicate outcomes in a timely fashion.
*	Individuals will generally be expected to raise complaints with the 
Employer before escalating to the Information Commissioner’s Office (“ICO”).

2. Enhanced transparency (including AI and automated decision-making)

*	Employers must clearly explain how and why personal data is used, 
including where AI or automated decision-making is involved.
*	Individuals must be able to challenge decisions and seek human review 
where appropriate.

3. Strengthened complaint rights

*	Employees have a clearer statutory right to raise data protection 
complaints with their Employer.
*	Employees do not need to obtain any specific wording or format to raise 
their concerns.
*	Employers must be able to assess whether a complaint is being made and 
then adopt structured, documented and auditable processes.
*	Failure by an Employer to do so, could amount to a breach of Data 
Protection Law.

4. Data Subject Access Requests (DSARs)

*	Employers are required to carry out reasonable and proportionate searches 
rather than exhaustive searches.
*	The Act clarifies the ability to ‘stop the clock’ where clarification is 
required.

5. Lawful basis – recognised legitimate interests

*	Certain processing activities can rely on recognised legitimate interests 
without a full balancing test in each case.
*	Employers should review processing activities and update documentation 
accordingly.

6. International data transfers

*	Transfers may be permitted where protections are not materially lower than 
UK standards.
*	Employers should review existing transfer mechanisms and documentation.

What employers should do now

*	Implement a formal data complaints policy
*	Update privacy notices
*	Audit DSAR handling processes
*	Review lawful bases for processing
*	Train HR teams and managers
*	Ensure robust record-keeping




Commentary

The Act raises expectations around governance and accountability. While it 
does not radically change substantive rights, it is likely to increase 
Employee awareness of data rights and may lead to more complaints alongside 
grievances or tribunal claims.




Conclusion

The Act reinforces the importance of robust data governance. Employers 
should focus on transparent, consistent and timely handling of data issues. 
Employers must demonstrate effective systems to receive, process and resolve

Employers, the Act represents a shift towards greater accountability, =
transparency and procedural formality in how employee data is =
handled.&#xa0;</p>
<p style=3D"text-align: justify; margin: 0;" align=3D"justify"><br></p>
<p style=3D"text-align: justify; margin: 0;" align=3D"justify"><span =
style=3D"font-weight: bold;">1. Mandatory data protection complaints =
process (from 19 June 2026)&#xa0;</span></p>
<ul style=3D"margin-top: 0; margin-bottom: 0;">
<li style=3D"text-align: justify;">All organisations that process =
personal data must implement a formal complaints procedure.&#xa0;</li>
<li style=3D"text-align: justify;">Employers must provide accessible =
channels for complaints, acknowledge them within 30 days of receipt, =
investigate and respond without undue delay and communicate outcomes in =
a timely fashion.&#xa0;</li>
<li style=3D"text-align: justify;">Individuals will generally be =
expected to raise complaints with the Employer before escalating to the =
Information Commissioner&#x2019;s Office =
(&#x201c;ICO&#x201d;).&#xa0;</li>
</ul>
<p style=3D"text-align: justify; margin: 0;" align=3D"justify"><span =
style=3D"font-weight: bold;">2. Enhanced transparency (including AI and =
automated decision-making)&#xa0;</span></p>
<ul style=3D"margin-top: 0; margin-bottom: 0;">
<li style=3D"text-align: justify;">Employers must clearly explain how =
and why personal data is used, including where AI or automated =
decision-making is involved.&#xa0;</li>
<li style=3D"text-align: justify;">Individuals must be able to challenge =
decisions and seek human review where appropriate.&#xa0;</li>
</ul>
<p style=3D"text-align: justify; margin: 0;" align=3D"justify"><span =
style=3D"font-weight: bold;">3. Strengthened complaint =
rights&#xa0;</span></p>
<ul style=3D"margin-top: 0; margin-bottom: 0;">
<li style=3D"text-align: justify;">Employees have a clearer statutory =
right to raise data protection complaints with their =
Employer.&#xa0;</li>
<li style=3D"text-align: justify;">Employees do not need to obtain any =
specific wording or format to raise their concerns. </li>
<li style=3D"text-align: justify;">Employers must be able to assess =
whether a complaint is being made and then adopt structured, documented =
and auditable processes.&#xa0;</li>
<li style=3D"text-align: justify;">Failure by an Employer to do so, =
could amount to a breach of Data Protection Law. </li>
</ul>
<p style=3D"text-align: justify; margin: 0;" align=3D"justify"><span =
style=3D"font-weight: bold;">4. Data Subject Access Requests =
(DSARs)&#xa0;</span></p>
<ul style=3D"margin-top: 0; margin-bottom: 0;">
<li style=3D"text-align: justify;">Employers are required to carry out =
reasonable and proportionate searches rather than exhaustive =
searches.&#xa0;</li>
<li style=3D"text-align: justify;">The Act clarifies the ability to =
&#x2018;stop the clock&#x2019; where clarification is =
required.&#xa0;</li>
</ul>
<p style=3D"text-align: justify; margin: 0;" align=3D"justify"><span =
style=3D"font-weight: bold;">5. Lawful basis &#x2013; recognised =
legitimate interests&#xa0;</span></p>
<ul style=3D"margin-top: 0; margin-bottom: 0;">
<li style=3D"text-align: justify;">Certain processing activities can =
rely on recognised legitimate interests without a full balancing test in =
each case.&#xa0;</li>
<li style=3D"text-align: justify;">Employers should review processing =
activities and update documentation accordingly.&#xa0;</li>
</ul>
<p style=3D"text-align: justify; margin: 0;" align=3D"justify"><span =
style=3D"font-weight: bold;">6. International data =
transfers&#xa0;</span></p>
<ul style=3D"margin-top: 0; margin-bottom: 0;">

protections are not materially lower than UK standards.&#xa0;</li>
