Thank you for your email. You have indeed made it to the correct
department. 

 

Firstly, I can confirm that 37 Chandos Street is in fact a listed
building. It is listed as a group Nos. 31-37 Chandos Street including the
railings. See the list entry on Historic England's website below:

As I am sure you aware, in general terms, Listed Building Consent is
required for all works of demolition, alteration or extension to a listed
building that affect its character as a building of special architectural
or historic interest. The requirement applies to all types of works and to
all parts of those buildings covered by the listing protection including
the interior (possibly including attached and curtilage buildings or other
structures), provided the works affect the character of the building as a
building of special interest. It is a criminal offence not to seek consent
when it is required.

 

With regards to replacing windows to a listed building you would need to
apply for Listed Building Consent. Now, I have attached our guidance note
on Windows in Listed Buildings which is a good starting point to explain
WDC's position/advice. Obviously, without having seen the windows in
question I am only speaking in general terms here. If windows on a listed
building are considered by us to have architectural and/or historic
interest and contribute to the significance of the listed building, then
we would not support their replacement unless you can demonstrate that the
windows are beyond reasonable repair. If they could be repaired then it is
unlikely we would approve their replacement. If the windows are evidently
a modern addition to the building, we may support their replacement
provided that the replacement windows were of an appropriate material,
style, construction, glazing etc. Obviously, as I mentioned, this is all
subject to obtaining the relevant Listed Building Consent. 

 

Now, if it has been established that the principle of their replacement is
acceptable, we are unlikely to support the replacement of single glazed
windows with anything other than single glazing, particularly to principal
elevations. If increased thermal performance was required we would
recommend you consider secondary glazing which in most cases does not
require LBC. 

 

With regards to EPC ratings, listed building are generally considered to
be exempt. As stated on the government's website, under the section on EPC
exemptions, you don't need an EPC if you can demonstrate that the building
is 'listed or officially protected and the minimum energy performance
requirements would unacceptably alter it'. Therefore, if a residential
building is exempt from the requirement to have an energy performance
certificate, then the minimum E rating standards do therefore not apply.

 

Section 5 of The Energy Performance of Buildings Regulations 2012 explains
that there is an 'exemption' for listed buildings. However, the exemption
is qualified, and states 'insofar as compliance with certain minimum
energy performance requirements would unacceptably alter their character
or appearance'. Therefore, if such works would be considered detrimental
to the building's character or appearance as a building of special
architectural and historic interest, then the listed building is
considered exempt. You do not need to apply for an exemption. A listed
building is generally considered exempt due to its listed status.

 

Historic England give advice on EPCs and clarifies the above
qualification:

 

'The qualification covers works that might be carried out to the property
to improve its energy performance. These are works that would require
consent under Part L of the

building regulations (The Conservation of Fuel and Power) and would be
included in the recommendations section of an EPC report if one was
obtained. If such works would unacceptably alter the building's character
or appearance, then the listed building would qualify for an exemption.

 

The qualification does not relate to meeting the minimum energy efficiency
requirements (MEES) set out in the
<https://www.legislation.gov.uk/ukdsi/2015/9780111128350/contents> Private
Rented Sector Regulations (opens in a new window) (2015).'

 

It would depend on a case by case basis the extent and type of work
required in order to improve energy efficiency. For example, some measures
will have a very minimal impact on the character and appearance of the
building, such as changing to a more efficient boiler and installing
secondary glazing. Other measures, such as adding new double glazed
windows, could have a substantial and unacceptable impact on the character
and appearance of the Listed building. It is also worth noting that some
changes to improve energy efficiency may or may not require listed
building consent and I would always recommend you seek advice from us
first to check whether the works would require consent.

 

If you would like further clarification on whether we would consider any
energy efficiency upgrades to unacceptably alter the building's character
or appearance, then I would be happy to provide additional advice.

Hello

Looking for advice and assistance and was told that I need to get in touch
with your department.

I currently own 37 Chandos Street in Leamington which I am told is a grade
2 listed building. ( If you could confirm this please that would be a
help)

 

I'm currently trying to bring it into the 21st Century. In a nice way of
course. Trying not to change any features. As it will not pass an EPC due
to the window fittings which are currently blowing through a gale.

I would like to know what I can do to change them. 

I'm would like the same style obviously and in character with the original
building, I understand that the original glass does not conform to
building regs if I was to only get them repaired.

There is two street facing windows and two back, Not overlooked.

 

Can you advise what I can do? And what I can't do? Also are there any
grants in place that can help me with restoring the place. I currently
also have quite a lot of damp in the cellar.

 

Any help is appreciated

If I have the wrong department could you assist by pointing me in the
correct direction

Chandos Street in Leamington which I am told is a grade 2 listed =
building. ( If you could confirm this please that would be a =

class=3DMsoNormal>I&#8217;m currently trying to bring it into the =
21<sup>st</sup> Century. In a nice way of course. Trying not to change =
any features. As it will not pass an EPC due to the window fittings =
which are currently blowing through a gale.<o:p></o:p></p><p =
class=3DMsoNormal>I would like to know what I can do to change them. =
<o:p></o:p></p><p class=3DMsoNormal>I&#8217;m would like the same style =
obviously and in character with the original building, I understand that =
the original glass does not conform to building regs if I was to only =
get them repaired.<o:p></o:p></p><p class=3DMsoNormal>There is two =
street facing windows and two back, Not overlooked.<o:p></o:p></p><p =
class=3DMsoNormal><o:p>&nbsp;</o:p></p><p class=3DMsoNormal>Can you =
advise what I can do? And what I can&#8217;t do? Also are there any =
grants in place that can help me with restoring the place. I currently =
also have quite a lot of damp in the cellar.<o:p></o:p></p><p =
