We wrote to you in January 2024 to update you on regulatory changes from th=
e Financial Conduct Authority that impact how you can promote our financial=
products.
In our previous communication, we confirmed that from 7th February 2024, fi=
rms not authorised by the Financial Conduct Authority offering unregulated =
credit products were required to have their financial promotions approved b=
y a Gateway Firm.
The FCA recently published their financial promotions findings for Q4 2024,=
in which they confirmed that 528 alerts had been issued to unauthorised fi=
rms and individuals. Many of these involved financial promotions published =
online that do not meet FCA requirements. In almost all cases the FCA ruled=
that the websites be taken down.
In order to ensure your business meets the regulatory requirements detailed=
above, if you have not done so already, you are required to implement one =
of the following options;
Have your own financial promotions approved by a gateway firm
Instruct a gateway firm authorised by the Financial Conduct Authority to re=
view and approve your financial promotions. You are required to retain evid=
ence that the financial promotions used by your business are approved and s=
hare this with us upon request.
Use the approved financial promotions provided by V12 Retail Finance for on=
ward communication
Utilise the financial promotions we have created for you, available from yo=
ur V12 Resource Centre. These are V12-branded and must be used in their app=
roved format with no adjustments in any way.
Remove all unauthorised financial promotions
Remove all financial promotions across all sales channels. For more informa=
tion on what is deemed as a financial promotion, please refer to the V12 Re=
tail Finance Credit Advertising Guide.
Become authorised by the Financial Conduct Authority for appropriate activi=
ties
Arrange appropriate authorisations by the Financial Conduct Authority to in=
dependently approve your own financial promotions.
Our Introducer Oversight Team will continue to monitor each of our distribu=
tors' customer-facing communication. Should we identify that any financial =
promotions do not meet the requirements detailed above as per CONC 3.2.4 ( =
