Dear Robert,




We write further to a previous email sent in respect of your Jaguar/Land 
Rover diesel emissions claim in which we set out the option for you to 
change onto our new Damages Based Agreement (DBA).




You previously signed a Conditional Fee Agreement (“CFA”) with us, however 
in order to proceed with your claim we require you to switch to a Damages 
Based Agreement (“DBA”). This is in order to ensure that you are covered by 
the After the Event (“ATE”) insurance we have arranged with our funder, 
which covers our clients against the risk of having to pay the Defendants’ 
costs if we are unsuccessful.




A DBA is a different type of ‘no win – no fee’ agreement. Please read more

The documents include a copy of the full DBA. This is the contract about our 
fees and expenses and also includes notice of your right to cancel the 
agreement within 14 days, starting on the day after entering it.




We will be providing you with an updated client care letter in due course, 
which sets out the work we will perform, our initial advice and other 
details about how we will work with you.




Please note that your DBA will cover all vehicles you register with us which 
we identify as eligible to join the claim.




Please note that we will be unable to proceed with your claim unless you 
agree to our request to proceed under the DBA. This is because it is our 
clear advice that you should switch to a DBA form of funding because if you 
do not you will be at risk of having to pay the Defendants’ costs if you 
continue to pursue your claim under your original CFA. If you do not accept 
our advice and requested transfer, we are entitled to terminate our CFA with 
you. As such, if we do not receive a response from you by 7 days from today, 
we will proceed to terminate your file.
