y, here. =E2=80=8A New Unfair Dismissal Rights Arriving Sooner Than Many Em=
ployers Realise Employees Starting on 1 July 2026 Could Qualify to Bring Un=
fair Dismissal Claims From January 2027 The Employment Rights Act 2025 will=
introduce a significant reduction in the qualifying period required to bri=
ng an ordinary unfair dismissal claim. From 1 January 2027, the qualifying =
service requirement is expected to reduce from two years to six months. Whi=
le the formal implementation date is January 2027, employers should be awar=
e that the practical impact is already being felt. Why 1 July 2026 Matters =
An employee who starts employment on 1 July 2026 will have accrued six mont=
hs' service by 1 January 2027. As a result, they will immediately acquire t=
he qualifying service necessary to pursue an ordinary unfair dismissal clai=
m once the new rules take effect. This means that individuals recruited fro=
m 1 July 2026 onwards are, in practical terms, being hired into the new unf=
air dismissal regime. What This Means for Employers Employers have traditio=
nally had a longer period in which concerns about performance, conduct, att=
endance and suitability could be addressed before an employee obtained unfa=
ir dismissal protection. From January 2027: New recruits are likely to gain=
protection significantly sooner than under the current regime. Employers w=
ill need to identify and address performance or conduct concerns at an earl=
ier stage. Probationary periods will become increasingly important. Manager=
s will need to ensure that probation reviews are documented and conducted r=
egularly. Processes for extending or managing probationary periods should b=
e reviewed and updated. The change may also shorten the period during which=
employers provide a probation period, as it is common practice for such pe=
riods to be six months. This means that an employer has less time to decide=
if they can terminate employment with reduced unfair dismissal risk for em=
ployees who have already been recruited and are approaching the new six-mon=
th threshold. In addition and for many employers, the real significance of =
the reform lies not simply in employees acquiring rights sooner, but in the=
possibility that those rights may be backed by unlimited compensation for =
unfair dismissal, fundamentally changing the risk profile of dismissal deci=
sions from the earliest stages of employment. Action Points for Employers E=
mployers should consider taking the following steps now: =EF=BB=BF Review p=
robationary period provisions in employment contracts. Implement structured=
probation review meetings at regular intervals. Train managers on performa=
nce management during the probationary period. Ensure concerns are raised a=
nd documented promptly. Review dismissal and capability procedures to ensur=
e they remain fit for purpose. Assess recruitment and onboarding processes =
to ensure new hires are monitored effectively during their first six months=
. Looking Ahead The reduction in the qualifying period is one of the most s=
ignificant unfair dismissal reforms in recent years. Employers recruiting d=
uring the second half of 2026 should take steps now to prepare for a workfo=
rce that will obtain statutory unfair dismissal protection far sooner than =
has traditionally been the case. With January 2027 approaching, organisatio=
ns should ensure their probationary, performance and dismissal procedures a=
re robust and consistently applied. Employers are encouraged to keep abreas=
t of the developments in Employment Law and monitor further regulations and=
guidance confirming the final form of the changes within the Employment Ri=

ficant reduction in the qualifying period required to bring an ordinary unf=
air dismissal claim. From 1 January 2027, the qualifying service requiremen=
t is expected to reduce from two years to six months.</span></p>
<p style=3D"text-align: justify; margin: 0;" align=3D"justify"><br></p>
<p style=3D"text-align: justify; margin: 0;" align=3D"justify"><span style=
=3D"font-size: 15px;">While the formal implementation date is January 2027,=
employers should be aware that the practical impact is already being felt.=
</span></p>

>Why 1 July 2026 Matters</span></p>

=3D"font-size: 15px;">An employee who starts employment on 1 July 2026 will=
have accrued six months' service by 1 January 2027. As a result, they will=
immediately acquire the qualifying service necessary to pursue an ordinary=
unfair dismissal claim once the new rules take effect. This means that ind=
ividuals recruited from 1 July 2026 onwards are, in practical terms, being =
hired into the new unfair dismissal regime.</span></p>

>What This Means for Employers</span></p>
<p style=3D"margin: 0;"><br></p>

=3D"font-size: 15px;">Employers have traditionally had a longer period in w=
hich concerns about performance, conduct, attendance and suitability could =
be addressed before an employee obtained unfair dismissal protection.</span=

<p style=3D"margin: 0;"><span style=3D"font-size: 15px;">From January 2027:=
</span></p>

s are likely to gain protection significantly sooner than under the current=
regime.</span></li>

ill need to identify and address performance or conduct concerns at an earl=
ier stage.</span></li>
<li style=3D"font-size: 15px;"><span style=3D"font-size: 15px;">Probationar=
y periods will become increasingly important.</span></li>

ll need to ensure that probation reviews are documented and conducted regul=
arly.</span></li>
<li style=3D"font-size: 15px;"><span style=3D"font-size: 15px;">Processes f=
or extending or managing probationary periods should be reviewed and update=
d.</span></li>

mployers provide a probation period, as it is common practice for such peri=
ods to be six months.</span></p>

=3D"font-size: 15px;">This means that an employer has less time to decide i=
f they can terminate employment with reduced unfair dismissal risk for empl=
oyees who have already been recruited and are approaching the new six-month=

=3D"font-size: 15px;">In addition and for many employers, the real signific=
ance of the reform lies not simply in employees acquiring rights sooner, bu=
t in the possibility that those rights may be backed by unlimited compensat=
ion for unfair dismissal, fundamentally changing the risk profile of dismis=
sal decisions from the earliest stages of employment.</span></p>

most significant unfair dismissal reforms in recent years. Employers recrui=
ting during the second half of 2026 should take steps now to prepare for a =

than has traditionally been the case. With January 2027 approaching, organ=
isations should ensure their probationary, performance and dismissal proced=
ures are robust and consistently applied.</span></p>
