Dear Cooldad60,
We have updated the Nintendo Account Agreement, following new legal
provisions by the European Union (EU). With this update, Nintendo does not
change the way data is processed. The agreement was solely adapted to
reflect the latest changes in EU legislation.
The new legal provisions are the Regulation (EU) 2023/2854 of the European
Parliament and the Council of December 13th, 2023 (so-called Data Act) and
the Regulation (EU) 2024/3228 of the European Parliament and the Council of
December 19th, 2024 (Regulation on the discontinuation of the European
Online Dispute Resolution Platform).
The updated document supersedes all previous versions and applies to all
existing and new Nintendo Account users, including any supervised Nintendo
Account users, from September 12th, 2025.
Summary of changes to the Nintendo Account Agreement
* Article 1 (definitions) now includes an additional term that describes
non-personal generated data;
* Article 5 (use of generated data) now includes a provision on the use of
non-personal generated data, which has become necessary due to future new
legal provisions by the EU;
* Article 13 (termination and transfer of the agreement) now also takes into
account the non-personal generated data;
* Article 5 to 18 have been renumbered; and
* Article 6 of the Nintendo Shopping Services (information about online
dispute resolution and alternative dispute resolution methods) has been
removed as the European Union has discontinued the European Online Dispute
Resolution Platform.
